The reason I'm forcing every OLS member to now read and explicitly agree to the User Agreement is the blatant, widespread copyright infringement that takes place on a daily basis. Everyday, our sweepstakes and contest listings get unlawfully copied from our site and added to a large number of other sweepstakes sites, newsletters (including snailmail), newsgroups, message boards, etc. Make no mistake about it, there are more sweepstakes sites and newsletters that get the bulk of their sweepstakes and contest listings directly through OLS than don't.

I've been running a sweep site for the better part of 7 years now, and without a doubt, sweep "swiping" has always been around to some extent (a few here and there, with some give and take- some of our members have swiped as well). But over the course of the last couple of years, what was once a relatively benign problem has become much more rampant, to the point that a number of these other sweepstakes sites and newsletters now get most all of their sweep listings directly from OLS.


What's the big deal you say? When another sweepstakes site, newsletter or group takes our sweepstakes and contest listings:

1) They're taking all the hard work our editors, moderators, members and myself put into OLS. There are some very good reasons why OLS can list 2,000 new sweepstakes and contests every month (more if you count all the local and snailmail sweeps in the forums), and usually before anyone else does- our editors, moderators, members and myself. Together, as a community, we collectively produce our sweepstakes listings. We have the community, the people who are willing to volunteer, and the infrastructure in place to list the number of sweeps that we do. The other sites/newsletters/groups simply don't, so they either have to list far fewer sweepstakes and contests or they have to depend on swiping- and that's exactly what many of them do. When they depend heavily on swiping, especially from OLS, they don't need to do much else other than a lot of copying and pasting.

They don't have to have thousands of members who are willing to find, share and submit new sweeps, they don't have to have all the knowledgable volunteers (or employees) necessary to check all the details and edit all the submitted sweeps, they don't need to weed through all the sweeps that for one reason or another aren't listable, they don't need to email the sponsors with questions, they don't have to have all custom software necessary to run it all. Believe me, there's a hell of a lot more work that goes into a site like OLS than most of you will ever know. Instead of working their ass off to build a good web site and a supportive community, all they have to do is copy & paste all the information they need from right here at OLS- they don't even have to visit the sweeps' web pages. Collectively, we've done all the hard work for them.


2) It lessons our members' odds of winning. Enough said.


3) It greatly dilutes the value and the uniqueness of OLS both as a community and as a business. Why go to OLS when I can go elsewhere and find most of the same sweeps? And now that OLS is selling premium membership subscriptions, exclusive access to about half our sweeps being one of the primary benefits, you don't have to be a genius to see the very real damages that are being done by these other sites/newsletters/groups' rampant copyright infringement of our work.


Who are you to say that you "own" the sweep listings when you don't "own" the sweeps?
This is by far the most common justification given in defense of swiping. The idea that you have to own the subject of your creative work for it to be copyrightable is absolutely, 100% absurd. Following that "logic," I could just copy all the links in Yahoo's Directory (or just about any directory for that matter) and copy everything for my own competing web directory. Or I could go to ESPN or CNN and copy their stories and articles and present them as my own. After all, Yahoo doesn't "own" the web sites in it's directory, ESPN doesn't "own" all the sports teams they cover, and CNN doesn't "own" President Bush, Iraq or the recent elections.


But if I don't copy something word-for-word, or it's just basic facts, it's not copyright infringement.
From the U.S. Copyright Office's web site (http://copyright.gov/circs/circ65.html):

DEFINITION
An automated database is a body of facts, data, or other information assembled into an organized format suitable for use in a computer and comprising one or more files.

The copyright law does not specifically enumerate databases as copyrightable subject matter, but the legislative history indicates that Congress considered computer databases and compilations of data as “literary works” subject to copyright protection. Databases may be considered copyrightable as a form of compilation, which is defined in the law as a work “formed by the collection and assembling of preexisting materials or of data that are selected, coordinated, or arranged in such a way that the resulting work as a whole constitutes an original work of authorship.”


It is my right and more importantly my responsibility as the founder, owner and (alleged) leader of OLS to protect our collective work from those that take it. The click-thru User Agreement gives OLS an additional layer of protection against the copyright infringers. It carries much more weight legally than a more common "browse-thru" type of User Agreement which it was before now, and it's just one more tool at my disposal with which to battle the infringers. The days of OLS 'stocking the shelves' of other sweepstakes sites, newsletters and groups are coming to an end, to the great benefit of every single member of OLS, especially those that contribute the most to our site and community, and that's exactly what it's all about.

Our editors, moderators, members and myself haven't been busting our humps, many of us for years, just to let the results of all our hard work get taken so easily from us in order for somebody else can profit from it. And before anybody says something about me or us being greedy or selfish about it, there's absolutely nothing preventing anybody from coming to OLS to access the same sweeps, most for free. If it's about sharing sweeps than all anybody has to do is post a link to OLS. You want thousands of the latest and greatest sweeps, here ya go: http://www.online-sweepstakes.com/ . We're the ones that are unlawfully being taken advantage of here, it's not the other way around. And if you think I'm being greedy, recent criticisms aside (some fair and some not even close), then I'd love to hear your explanation as to why there have been almost NO advertisements (banner, text, affiliate, pop-ups, you name it) to speak of on this site for the last 3 years. It's not because I just hadn't thought of it, that's for sure.


The click-thru User Agreement that I have up now, is not very different at all from the one that's been there for the last 3 years, nor is it much different than just about any other user agreement that you'd find at most other web sites. In fact, the user agreement that we've had for at least 3 years prior has always said that accessing and using the OLS web site constitutes your agreement to the same terms and conditions; if you don't agree, then you shouldn't access or use OLS. It's always said just about everything it says now, all I did was force everybody to explicitly agree to it with a couple of mouse clicks, and straighten things up a little bit to make it a little more clear and relevant. And everybody who's purchased a premium subscription has had to agree to the following on the order page (http://www.online-sweepstakes.com/forums/subscriptions.php?):

By purchasing or making use of an OLS Premium Membership subscription, you agree to the Online-Sweepstakes.com Terms of Service (there's a link to the User Agreement here) and you agree to follow all OLS Site and Forum rules (and a link to the site and forum rules here). This service is offered as-is only, and no guarantees, explicit or implied, are given as to the availability, suitability, or usability of said service or any and all information contained therein. Terms and conditions are subject to change at anytime. All subscriptions are final and refunds will only be granted at the sole discretion of the owner of the OLS web site.

Very, very standard stuff. The fact is the bulk of the User Agreement came from some web site I found a few years ago that lets anybody input the name of their web site, answer a few simple questions, and voila- you get your own standard user agreement from a template.

Like I said, the biggest difference now is that everybody has to indicate their agreement by making a few clicks. Anybody that says they're surprised or concerned as to the terms and conditions in the agreement, has never taken the time to read virtually the same exact user agreement that's always been link to at the bottom of every single web page on this web site for at least the last 3 years.

One potential issue I do see with the new agreement, however, is the line that says "Any materials submitted, posted, uploaded or otherwise communicated to the Site become the copyrighted property of Online-Sweepstakes.com." Everybody that submits, posts or uploads something to OLS still owns the original copyright to their own work. I'm not intending to claim an absolute copyright over everything that comes through OLS. Rather, once something is submitted, posted or uploaded to OLS, I am claiming a copyright as it becomes part of a collective work, OLS. From the U.S. Copyright Office's web site (http://copyright.gov/title17/92chap2.html):

(c) Contributions to Collective Works. — Copyright in each separate contribution to a collective work is distinct from copyright in the collective work as a whole, and vests initially in the author of the contribution. In the absence of an express transfer of the copyright or of any rights under it, the owner of copyright in the collective work is presumed to have acquired only the privilege of reproducing and distributing the contribution as part of that particular collective work, any revision of that collective work, and any later collective work in the same series.

However, once something is submitted posted or uploaded to OLS (from our User Agreement):

You agree to grant to Online-Sweepstakes.com a non-exclusive, royalty-free, worldwide, perpetual license, with the right to sub-license, reproduce, distribute, publish, create derivative works from and publicly display any materials and information (including, without limitation, ideas contained therein for new or improved products and services) you submit to any area of the Site (such as the message board and the sweepstakes and contest directory) for any and all commercial and non-commercial purposes.

That's necessary to protect OLS from being sued for copyright infringement just for displaying or using any information submitted by anybody to the site. Without it, anybody that ever contributes anything to the site could, at anytime and for any reason, revoke their permission to OLS to use or display it. You'd have a hard time finding any web site that accepts user contributions of any kind that doesn't have the same kind of clause in their user agreement. With the clause, OLS basically has your permission to use anything submitted, posted or uploaded any way OLS wants. That does not mean that we are going to treat any submissions, posts or uploads any differently that we have before. All members are completely free to remove or edit any post, photo or upload themselves whenever they so choose.

OLS has never been, nor will it ever be about exploiting every single thing that it can to make a buck. I need to make a living just like everybody else to be sure, but I have always purposely run OLS in a decidedly non-commercial way, and though that's slowly changing a little bit, OLS will always be run like a community first, and a business second. I think that's perhaps the biggest difference between OLS and most of the other sweep sites, and I think that philosophy has been every bit as important to the success of OLS as anything else.

The only people that have cause to worry about anything are the rampant swipers. They'll be hearing from me soon. Everybody else should rest easy, remember, I'm on your side, not against you. :gvibes:

As a member of both online and snail memberships I am happy to see this being enforced. It has been stated here and on the other sites I belong, that stealing info to post at another IS NOT ALLOWED -- when will people get it?

Another abuse that I am aware of is "loaning" people your id and password so they may also access the site(s). A little bit of a crappy move me thinks. But if you are a loser and feel it's o.k., then perhaps it too will be o.k. when the sweeping gods wreak havoc among you. Blah, blah, blah - you get the point!

AGAIN, THANKS BRENT AND MODS FOR THIS SITE TO WHICH I HAVE PROUDLY BEEN A MEMBER OF SINCE 2002!

I don't know what the purpose is of "stealing" sweeps. I just don't get it. But I don't do it, so I won't worry about it. Anyway, thanks for all the explaining and yes, I read it! Thanks for this wonderful site!!

The only one who will have a problem is the ones stealing from OLS. Legit members will have no problems.
And once Brent can do something about the "swipers" we'll all have better odds of winnig. :smile9:

It means better odds for all of us OLSers, how could anybody not like that! I visit this site everyday sometimes just to read posts, but mostly to enter sweeps. I am so glad I found this site the first day I started looking for a sweeps site. I didn't look any farther. I have found a place I love and many friends that like dreaming like I do. I helped my best friend overcome her fear of a certain kind of contest, and she helped me with a membership when I was at the lowest of low. I love this place man, you do what you need to do to remove the scumbags that are stealing.

P.S. KB deserves a big CHEERS for all the hard work she has been doing lately. I miss ya hon.

I came to sweep. I personally do not want someone here that is stealing sweeps and

taking my chance of winning away.

I wholeheartedly support your efforts to fight copyright infringement. Like many OLS members, I use several sweeps websites, and wonder whether there is any way we can help to identify and report sweeps swipers. :sherlock:

I'm with you 100%. I hope you bust the folks swiping your hard work and I hope you publish the actions that you take. Let them see you can not copy off this site and get away with it.

I have looked at other contest sites and nothing comes close to OLS. It is well worth the paid membership. Thanks for your efforts to keep OLS the best.

I do hope you're successful in getting rid of the problem. Unfortunately, I don't think forcing people to agree to terms again will do much to stop the problem. People already "agree" to the terms when they become a member of the site to begin with If they didn't already take the agreement seriously, why would they now? And even if you can track them down and kick them off of OLS, there will be others to come along and do the same thing.

This is by far the classiest sweepstakes site on the web.The others can't even hold a candle to OLS.I think it's despicable when unscrupulous people infringe upon others copyrights. :mad2: They are so dense that they think they've done nothing wrong.They have a Machiavellian attitude that the end justifies the means. I am new here. As you can see since end of July 2004. I do not know you but I have enjoyed this site, thanks to your hard work and the mods hard work and being so dedicated.
If I could afford a PREMIUM MEMBERSHIP, I sure would purchase it. I have been drawing un-employment. But just as soon as the Good Lord Blesses me I will certainly purchase.
Like I said I am new but it appears (reading forums) that things have been going well at this site. And if the odds of OLS's winning are better, I am all for it.

I remember a really good sweep site called Huronline. They were put out of business because of this very problem. I would really hate to see that heppen again. Go for it, Brent Do what you have to do to protect yourself and this community.

I am a non-premium member and have NOT swiped a sweep. :rolleyes: I also don't know if sweepstakes can have a copyright since they are posted for the public by the sweepstakes company??

If it helps to send out an additional notice then great. I would love to win more, :gift: as my biggest OLS win is $176 to date. I have won 2 that were over $1000 but one was from the youngun watching the television and the other was from elsewhere.

Yes, I like OLS and think that in general it is a great group of people. In general, I think that the people that sweep are the same bunch and if they don't find a sweep available for them at OLS they look around and find it on another information sharing site. If the premium sweepstakes are not even visible to the non-premium members then it would be impossible for them to swipe them.

Good work. I've had many discussions with my three now-grown children about Napster, downloading, and the theft of creative works like OLS. Downloading music (illegally) is no different than tucking the CD into your shirt and walking out of the store at the mall. Call it shoplifting. Call it piracy. Call it Napster. It is taking something without paying for it, which is Theft. We've become so jaded about it that the first response to yet another story about the Theft of intellectual/creative property is usually "yada, yada, yada". Of course, if a neighbor decided to tap into your cable, water, gas, Internet, sewer, and electricity -- while you keep paying the bill -- how many of us would shrug it off with "yada, yada, yada"?
And there's no difference with OLS. I'm paying for a premium membership. As subscriptions go, it doesn't cost much. I've earned it back many times over already...and I've yet to win a grand prize. But I don't like paying for something that other people have gotten "free" by stealing it.
So thanks for protecting your investment and my hobby.
I'll be renewing my subscription next year.

Recently I got heads-up on a sweepstakes, one that was not listed here nor on another site I subscibe to. (The other site is for my snailmail, and listing's I print out to do my snails). Anyways, I am a paying member of both sites. So when I got the sweepstakes information, I wanted to post it, BUT, I couldn't choose which site I should post it too, and didn't feel it was appropriate to post it to both places, so I did nothing. (Accept enter....sorry...I ain't a saint, ya know! :halo: ) My question is, what should I have done? The other site offers incentives to posters of sweepstakes, (this one might too, I just don't ever post sweeps, just enjoy the ones all of you work so hard posting! :) ) but I still don't want to post it there and here nor do I want to post it in just one, as I'm loyal to both. Trying to have ethics ain't as easy as it looks.

This is why I don't post sweeps. Am I alone in this thought process????

I belong to other sites as well, I do not post sweeps I get from here or the other boards. If I post a sweep anywhere it is because I recieved an email from a sponsor advertising their sweeps or I found it surfing on a sponsors site. I have read numerous posts on other boards about the answers being posted on OLS which I (JMHO) don't think is right either. I applaud Brent for trying to make the rules clearer for everyone and thought his "(alleged)
leader" comment was cute! :)

I don't go to any other sites but this site for my sweeps because frankly I would get confused and enter the sweeps twice since i have nothing but my favorite to keep them in .
For some reason my sweeps doesnt work on my comp probably my security settings ,so I
keep a few in my favorites for days I cant get on here for some reason or other.I don't enter sweeps from my emails till I get on here and check if it's on a day I entered.I don't go to any of the sites I used to go to cause of the confusion it would cause. As for posting I wouldnt know how to post w/o a mod checking my post .A big thanks to the mods here! I
guess there are people that steal sweeps since Brent says so and he should know but I
can't figure out why they would do it .What's the purpose of stealing a sweep .Oh well just

I agree with you 100%. I've been a member alittle over a year now & in that time I have learned alot about you & this site. You have worked very hard to get OLS to where it is now. And for someone to just come in and steal what they want for their own site would make me do the same thing if I was the owner. I have been hoping that you would do something like this since you posted the "Copyright infringement sweeps" this past summer. I hope you catch and prosecute the theives! I only use OS. It is the best! I agreed to the agreement to use this site.

I totally back Brent and OS in protecting the copyright of the sweeps here. Unless this is stated in the user agreement, all of their work here is not protected. The OS staff has worked for years with substandard compensation and I hope the OS staff makes a ton of money with this site. Each of them have really earned that right.

I am not worrying about the copyright issues associated with posting in the Forums, I will just watch carefuly what I post. I think the language used in this part of the user agreement does not protect my interests for ideas that I submit here. I think OS could protect itself by saying that it has the right only to use the information on online-sweepstakes.com. But the agreement goes beyond this with these words:
You agree to grant to Online-Sweepstakes.com a non-exclusive, royalty-free, worldwide, perpetual license, with the right to sub-license, reproduce, distribute, publish, create derivative works from and publicly display any materials and information (including, without limitation, ideas contained therein for new or improved products and services) you submit to any area of the Site (such as the message board and the sweepstakes and contest directory) for any and all commercial and non-commercial purposes. Any materials submitted, posted, uploaded or otherwise communicated to the Site become the copyrighted property of Online-Sweepstakes.com.

I belong to three sweeps sites, two I pay for, one is free and except for a few sweeps here and there, they all pretty much have the same sweeps as far as I can tell. I don't blame him for wanting to contain and protect his own content, I just don't know how he could enforce it or prove a sweep has been lifted from his site.

But, I will do everything on my part to abide by the rules that I agreed to as being a paid member here!

If you didn't learn about the sweepstakes through OLS or another sweeps listing source, there is nothing wrong with you posting it both here and anywhere else you want to list it. The only thing we would ask is that you not copy our format for posting your find on other sites. As the one who "found" the unposted sweeps, it would not be swiping for you to post it to multiple boards but it would be violating the OLS copyright to use our sweep posting format.

Hope that clears things up for you and that you will feel free now to share your sweeps find with the rest of us here. :)

I know sweeps can be found anywhere but I think a big part of why Brent is doing this is because when sweeps get added to the site they are then edited by a great group of people who work really hard to make them uniform and coherent. So although the sweeps are for everyone, by the time the editors go through them, add liknks, correct typos, make corrections and make them consistent, it's time and energy spent to make it easy for us members to enter them. So to have somebody come on the site and swipe the finished product is like stealing because they did no work in finding these sweeps for their sites.

So keep up the good work Brent because this site is by far one of the best on the web. Thanks to the mods and editors as well who keep it running!!

I'm not a real technical person, but I was wondering if you listed a fake site that offered to "out" swipers and included a field to capture their emails, do you think people would sign up?

Hey, all I've got to say is that I don't know how or why anyone would do this..not that I'm questioning that they are but they would only be hurting themselves. Anyway, I don't personally know anyone who is interested in sweeping (crazy-huh?) even after they see me winning so loaning out my password isn't something that I do and who has time to visit other sweeps sites? I can't even get all of them done on here.

I am glad that this subject came up and is being enforced, it will keep things going well at OLS for all of us.

P.S. I thought the fake site idea submitted earlier was a great one.

hehehe I remember that. It was posted WORD FOR WORD on another sweepstakes site. Including as you mentioned, the "arse kicking" as the grand prize. I think it was a site run from out of the Country though so I don't know how the US laws would affect them.

In my opinion, regarding the people who are swiping & stealing to post on other sites, I'm sure the membership fee is nothing to them especially if they are in turn making money off their own site. If they are charging their members a fee to access their own site, they couldn't care less if they have to pay just "1" membership here to get all access.

I really hope that Brent can do something legally about these turds. :mad2:

I have no problem agreeing to the copyright laws here. I personally search and do post new sweepstakes here {that have not yet been posted} as often as I can.. that are not found any where else on the net.. most of my posts are made "Premium". I do see that the some of posts that I have made here are posted @ other sites. I am a member @ many sites.. and have seen that other sites too.. have the same rules regarding copying posts. "Other sites" will actually track down the member.. if they post sweeps from their site.. to another site..they will ban the member from the site.

I totally agree w/you Brent & I hope the members posting sweeps from here to "other sites" do not mess w/you! :toot:
